A reported dementia diagnosis could complicate any potential criminal case involving Thomas Markle Sr. if it leaves him unable to understand proceedings or assist with his defense. However, experts told Page Six that a diagnosis by itself would not automatically shield him from arrest or settle questions of legal responsibility. No charges have been announced in connection with the allegations.

Former FBI agent Jason Pack said investigators could still make an arrest if they had probable cause. He described a person’s ability to participate in court proceedings and their responsibility at the time of alleged conduct as separate legal questions, neither of which is answered by a diagnosis alone.

Neurologist Dr. Jeremy M. Liff said a neurological disorder could complicate efforts to determine whether Markle, 82, was capable of making decisions at the time of the alleged offenses. Dementia can affect inhibition, Liff noted, but he cautioned that it should not automatically be treated as an explanation for the specific allegations. Whether a person could carry out the steps involved would be relevant, he said, and each case must be assessed individually.

Forensic psychiatrist Dr. Carole Lieberman said that if Markle were charged, his legal team could seek assessments from medical experts. These might include a review of medical records, psychological and psychiatric evaluations, and neurological testing. If a court found him incompetent to stand trial, efforts could first be made to restore his competency. If that proved unsuccessful, the charges could potentially be dismissed or he could be placed in an appropriate inpatient setting, Lieberman said. Such an outcome is not automatic.

The allegations surfaced after Thomas Markle Jr. reportedly contacted authorities, saying he had found hundreds or possibly thousands of images depicting child sexual abuse among belongings at his father’s former home in Cebu. Markle Sr. has denied the accusations, calling them “sick lies” and telling the Daily Mail he had never downloaded such material. Meghan Markle has said she was “deeply distressed” by the allegations and that keeping her children away from their grandfather was a protective decision.
