Secret Service agent John Spillman has agreed to enter a six-month pre-trial diversion program in connection with an indecent exposure case stemming from an incident at a Miami hotel. The program could lead to the charges being dismissed if he completes its requirements, according to the Miami-Dade State Attorney’s Office, as reported by TMZ.
Office spokesperson Ed Griffith said the court offered Spillman the program because the alleged offense is considered a lesser, non-violent crime. Spillman is required to attend classes related to the offense, take part in self-help and instructional programs, complete drug and alcohol education, and perform 60 hours of community service. If an evaluation determines that he needs a mental health examination, he must undergo one.
A judge also issued three orders barring Spillman from approaching or contacting the hotel and two guests who were present on May 4 at the DoubleTree by Hilton Hotel Miami Airport & Convention Center. If Spillman does not complete the program, prosecutors will proceed with the charges, Griffith said.
Police said Spillman followed guests from the hotel lobby to their room and began masturbating in the hallway. He was arrested at the scene. His attorney, Michael Mirer, told TMZ that Spillman was pleased the matter had been resolved and that all charges would be dismissed.
