KJ Biermann’s attorneys are challenging all seven felony charges against him, arguing that prosecutors have not supplied enough information to support key elements of the case, according to court documents obtained by Page Six.

Attorney Jason Sheffield argues that the aggravated child molestation charge does not specify the physical injury allegedly caused. He also says the aggravated sexual battery and sodomy charges do not adequately describe how force was allegedly used. The defense claims three sexual battery counts are nearly identical and says the false imprisonment charge does not explain how Biermann allegedly restrained the accuser.

His lawyers are requesting a hearing and want the lead detective to testify. Biermann, 15, has maintained his innocence and pleaded not guilty to all seven charges in October.

He was arrested in August after a female classmate accused him of sexually assaulting her in a Georgia gym changing room in April. She alleged that he forced her to perform oral sex and digitally penetrated her despite her objections.

Prosecutors have also previously alleged that investigators found videos on Biermann’s phone showing sexual acts involving an underage relative. Sheffield disputed that description, characterizing the earlier incident as inappropriate behavior between middle schoolers.

Biermann spent about a month in jail before being released on bond. He is now confined to his mother’s home while the case proceeds.
