Prosecutors in Solano County have filed a petition to transfer the case of 17-year-old Monte Smith from juvenile court to adult court. Smith is charged in connection with a shooting at a Spirit Halloween store in Fairfield, California, that killed Constance Hages and injured six other people on October 30.

Police said the shooting occurred inside the store at Solano Town Center. Investigators believe Smith was targeting one of the other customers who was shot. Hages, 31, died at the scene; her family told detectives she was 13 weeks pregnant.

Smith was arrested on November 2 after allegedly fleeing the store. Police said a school resource officer identified him after reviewing surveillance footage and recognizing him as a former student. The district attorney’s office publicly identified Smith the following day, after police had initially withheld his name because of his age.

On November 3, prosecutors charged Smith with two counts of murder with a multiple-murder special circumstance, three counts of attempted murder and three counts of assault with a semiautomatic weapon, along with gun enhancements. The charges also include an allegation related to a prior violent-offense conviction. Smith was scheduled to appear in juvenile court on November 4. The report did not say whether he had a lawyer or had entered a plea.

Police said three of the six other people who were shot were in critical condition on October 31: a 16-year-old boy, a 19-year-old man and a 32-year-old man. A 23-year-old man was reported in critical but stable condition, while two others—a 19-year-old man and a 43-year-old man—were treated and released.

Prosecutors said they would argue that Smith remain detained, citing the seriousness of the alleged crimes, his criminal record and public safety concerns. Fairfield police said Smith had previously been sentenced and released in connection with a 2025 shooting at a local high school.

Clanisha Morton, who identified Hages as her niece, set up a fundraiser for Hages’ four children. Morton wrote that the family was grieving the loss of a loved one and facing a profound absence in their lives.
